Terms & Conditions
Effective Date: June 2025
Welcome to Nolly Studio. These Terms & Conditions (“Terms”) govern the use of our services, including but not limited to digital design, branding, web development, interior styling, and all consultations and communications.
Scope of Services
Nolly Studio provides creative services as outlined on our website or within your proposal or invoice. Additional services not listed or agreed upon in writing will incur additional charges.
Payment Terms
All quotes are valid for 14 days from the date of issue.
A 50% deposit is required to begin any project, unless otherwise agreed in writing.
The remaining 50% is due upon final delivery or project completion.
Pay-as-you-go services are billed in full before any work begins.
Late payments may incur a 10% monthly interest charge.
Subscription Plans
Our monthly subscription service requires a minimum 6-month commitment.
Upon sign-up, your card details will be securely stored, and monthly payments will be debited automatically on the 25th of each month.
Subscription services include unlimited digital design work as outlined in your plan.
Late or missed payments may incur a 10% interest fee. Continued non-payment may result in service suspension until outstanding payments are received.
Subscriptions are non-refundable. Early cancellation prior to the 6-month term may result in a termination fee equivalent to three month’s subscription.
Cancellations & Refunds
Deposits are non-refundable unless otherwise stated.
If the client cancels the project after work has commenced, Nolly Studio reserves the right to invoice for all work completed up to the cancellation date.
In the event of unforeseen circumstances or force majeure, both parties agree to renegotiate project timelines.
Intellectual Property
Final approved designs become the property of the client after full payment is received.
Nolly Studio retains the right to showcase completed work in our portfolio and marketing materials unless a written NDA is in place.
Working files (e.g. PSDs, .AI, Figma, etc.) are not included unless agreed upon in the proposal and may incur an additional release fee.
Client Responsibilities
Clients are responsible for providing all necessary content, feedback, and materials within agreed timelines.
Delays in content delivery or approvals may result in project delays or rescheduling.
Revisions
Projects include up to 2 rounds of revisions unless otherwise agreed.
Additional revisions will be charged at our standard hourly rate (R750/hour).
Limitation of Liability
Nolly Studio shall not be held liable for any damages resulting from the use or misuse of delivered materials, nor for delays caused by external suppliers or unforeseen technical issues.
Confidentiality
We treat all project materials and conversations with discretion. Confidential information will not be shared or disclosed without permission.
Governing Law
These Terms are governed by the laws of South Africa. Any disputes will be handled in accordance with South African legal procedures.
Updates to Terms
Nolly Studio reserves the right to update or change these Terms at any time without prior notice. Continued use of our services constitutes acceptance of any modifications made.
